1. Acceptance of Terms
By accessing or using Ardaven services, you agree to these Terms of Service. If you do not agree with any part of these terms, you should not use our services.
2. Description of Services
Ardaven provides conversational commerce services for D2C brands, including:
- WhatsApp sales bot with interactive catalog.
- Payment processing via MBWay and card.
- Order, catalog, and stock synchronization with Shopify and WooCommerce.
- Conversational AI agent for customer support.
- Order tracking and proactive notifications.
- Analytics dashboard and order management.
Available services depend on the subscribed plan.
3. Subscription and Payment
- Plans are billed monthly.
- A 1.5% transaction fee applies to all sales processed through Ardaven.
- Prices are listed on our pricing page and may be updated with 30 days notice.
- Payment is due at the beginning of each billing period.
- In case of payment failure, we reserve the right to suspend the service after notification.
4. Usage Limits
Each plan includes specific channel and feature limits. Usage above plan limits may result in the need to upgrade your plan. We will be transparent about any changes before applying additional charges.
5. User Obligations
By using our services, you agree to:
- Provide accurate and up-to-date information about your products and prices.
- Use the services in accordance with applicable laws.
- Not use the services to send spam or unsolicited communications.
- Comply with WhatsApp Business and other messaging platform policies.
- Keep your account credentials confidential.
6. Intellectual Property
All content, software, and technology of Ardaven remain the property of the company. No license or intellectual property rights are granted beyond what is necessary to use the subscribed services.
7. Limitation of Liability
Ardaven provides services "as is". To the extent permitted by law:
- We do not guarantee that services will always be available without interruption.
- We are not liable for indirect, consequential damages, or loss of revenue.
- Our total liability is limited to the amount paid in the last 3 months of service.
8. Cancellation
- You may cancel your subscription at any time with 30 days notice.
- After cancellation, your data will be retained for 30 days before deletion, unless legally required otherwise.
9. Governing Law
These terms are governed by Portuguese and European Union law. Any disputes will be submitted to the competent courts of Portugal.
10. Changes to Terms
We reserve the right to modify these terms. Changes will be communicated with 30 days notice by email. Continued use of the services after the change constitutes acceptance of the new terms.
